When Congress passed the Secure Fence Act last year, like most Americans I assumed our government would proceed to build the 854 miles of double-layer fencing specifically mandated by the Act. Boy was I wrong. I was shocked to find out that last year Congress gave DHS discretion to build whatever type of fence it deemed necessary, wherever it deemed (or didn’t deem) a fence. And now Congress is getting ready to repeat this terrible mistake on the DHS Appropriations bill, now in House-Senate Conference. I am calling on Congress to do two things on this Appropriations bill. First, fully fund the double-layer fence mandate outlined in the Secure Fence Act. Second, eliminate any language or amendments (such as Sen. Hutchison’s SA 3176 that was attached to DOD appropriations) that give DHS discretion over how and where and if to build a fence. Instead, the double-layer fence should be fully funded AND DHS should be required to comply with the mandates of the Secure Fence Act.
